1. Acceptance of terms

By accessing or using openwindowtoday.com ("the Site", "the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.

The Service is operated by Akshay Gawli ("we", "us", "our"), based in Melbourne, Victoria, Australia.

2. The service

Open Window Today provides home-guidance information based on live weather and air quality data. The Service offers 32 checks covering windows, laundry, health, garden, family activities and home maintenance, each returning a Yes, No or Wait recommendation with a plain-English reason.

The Service is provided free of charge. We reserve the right to modify, suspend or discontinue any part of the Service at any time without notice.

3. Data usage

When you use the Service, the following data is processed:

• Location data — the city name or GPS coordinates you provide are sent to OpenWeatherMap to retrieve weather data. This data is not stored by us. See our Privacy Policy for full details.
• Weather & air quality data — sourced from OpenWeatherMap's API. This data is cached in your browser's sessionStorage for up to 10 minutes to reduce latency. It is never transmitted back to our servers.
• Saved locations — stored in your browser's localStorage on your device only. We have no access to this data.
• Analytics — anonymous, aggregated usage data collected via Google Analytics 4. No personally identifiable information is collected. IP addresses are anonymised before processing.
• Feedback — submitted voluntarily via your email client. We use it only to improve the Service and respond to your query.

We do not sell, rent, or share your data with third parties for commercial purposes. Full details are in our Privacy Policy.

4. Accuracy disclaimer

Weather data comes from OpenWeatherMap and is subject to their data accuracy and availability. UV index is estimated, not directly measured. Pollen risk is derived from weather conditions, not real-time pollen sensors. Barometric pressure readings used for the migraine card are indicative, not clinical.

While we aim to provide accurate and timely information, we make no warranties or representations, express or implied, about the completeness, accuracy, reliability or suitability of the information provided. You use the recommendations at your own discretion and risk.

For medical conditions — including asthma, migraines, allergies, skin conditions, or any other health concern — always consult a qualified healthcare professional. Do not rely solely on our cards for health-related decisions.

5. Limitation of liability

To the maximum extent permitted by applicable law, Open Window Today and its operators shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to:

• Damage to property resulting from acting on our recommendations (e.g. paint damage, plant damage)
• Health outcomes resulting from acting on our health-related cards
• Damage from weather events not predicted or reflected in our data
• Loss of data or service interruption

Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted in the relevant jurisdiction. Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.

6. Acceptable use

You agree not to use the Service to:

• Attempt to reverse-engineer, scrape at scale, or systematically extract data from the Service beyond normal use
• Circumvent any rate limiting or technical measures we have in place
• Misrepresent the Service's outputs or present them as professional advice
• Use the Service for any unlawful purpose

Personal, non-commercial use — including sharing cards with friends and family, embedding screenshots in blog posts, or referencing our cards in journalism — is encouraged and does not require permission.

7. Intellectual property

The Open Window Today name, logo, code, visual design, written content, and card logic are the intellectual property of Akshay Gawli. You may not reproduce, distribute or create derivative works without prior written permission.

Weather data displayed on the Site is sourced from OpenWeatherMap and is subject to their terms of use. We do not claim ownership of this data.

Sharing individual card results (screenshots, images generated by the share feature) for personal, non-commercial purposes is permitted and encouraged.

8. Third-party services

The Service relies on the following third-party services, each governed by their own terms:

• OpenWeatherMap — weather data provider. Subject to OpenWeatherMap Terms.
• Google Analytics — anonymous usage analytics. Subject to Google Terms.
• Google Fonts — typography. Subject to Google Fonts Terms.

We are not responsible for the terms, availability or practices of these third-party services.

9. Service availability

We aim to keep the Service available at all times but make no guarantees of uptime or availability. The Service may be temporarily unavailable due to maintenance, third-party API outages (particularly OpenWeatherMap), or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

10. Changes to these terms

We may update these Terms at any time. Updated terms take effect immediately upon posting. The "Last updated" date at the top of this page reflects when changes were last made. Continued use of the Service after changes constitutes acceptance of the revised terms.

11. Governing law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

If you access the Service from outside Australia, you do so on your own initiative and are responsible for compliance with applicable local laws.
